Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the FansSpacewebsite, mobile application, and online store (together, the "Services"). The Services are owned and operated by Focus Media Communications Inc.("we," "us," or "our").

By browsing the site, creating an account, downloading the app, placing an order, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

FansSpace is a brand and platform of Focus Media Communications Inc.. We offer official and partner-licensed merchandise, digital guides, and a companion app for event experiences (including fan guides and photo/video uploads) related to sports, esports, live events, gaming, creators, and similar verticals. References to "FansSpace" in these Terms mean Focus Media Communications Inc. acting through the FansSpace brand.

• You must be able to form a binding contract in your jurisdiction. If you are under the age of majority where you live, you may use the Services only with consent of a parent or legal guardian.
• You are responsible for keeping account credentials confidential and for activity under your account.
• Information you provide must be accurate and kept up to date. We may suspend or close accounts that violate these Terms or applicable law.

Product descriptions, availability, and prices may change without notice. We reserve the right to refuse, cancel, or limit any order (including suspected fraud, pricing errors, or stock issues). If we cancel a paid order, we will refund amounts charged for that order.

Checkout may be processed on our site or through a third-party commerce provider (for example, Shopify-hosted checkout). Payment methods shown at checkout (such as card, Shop Pay, PayPal, or digital wallets) are subject to the processors' terms. You authorize Focus Media Communications Inc. and its payment partners to charge the payment method you select for the order total, including applicable taxes and shipping.

Delivery options, fees, destination coverage, and product-type shipping rules are described in our Shipping policy, which forms part of these Terms. Title and risk of loss for physical goods pass according to the carrier's terms once the order is handed over for shipment, except where mandatory consumer law provides otherwise. Digital products are delivered electronically and are not shipped.

Returns, exchanges, final-sale items, shipping-cost treatment, and EU withdrawal rights are governed by our Refund policy. Subscriptions, pre-orders, and try-before-you-buy purchases are also subject to our Cancellations policy. For authorization and inquiries, contact support@fansspace.com.

• Digital guides, downloads, and in-app unlocks are licensed for your personal, non-commercial use unless we state otherwise.
• Except as allowed by law, you may not copy, resell, redistribute, or reverse engineer digital products or licensed materials.
• Partner or rights-holder marks appearing on merchandise or in the app remain the property of their respective owners. Purchase does not transfer intellectual property rights beyond the product you receive.

The mobile app may let you view event guides and upload photos, videos, captions, and related materials ("User Content"). You retain ownership of your User Content. By uploading, you grant Focus Media Communications Inc. a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that User Content in connection with operating, promoting, and improving the Services, including event partner showcases, subject to moderation and privacy settings we make available.

You represent that you have the rights to upload User Content and that it does not infringe others' rights or violate law. We may remove or restrict User Content that is unlawful, abusive, infringing, or otherwise inappropriate.

You agree not to misuse the Services, including by attempting unauthorized access, scraping at abusive volumes, interfering with other users, uploading malware, impersonating others, or using the Services for unlawful marketing or fraud. We may investigate and take action, including suspension and cooperation with authorities where required.

The Services—including branding, design, text, software, and selection/arrangement of content—are owned by Focus Media Communications Inc. or its licensors and are protected by intellectual property laws. You may not use FansSpace or Focus Media Communications Inc. marks without prior written permission, except for limited personal use of materials we expressly make available for that purpose.

The Services may link to or integrate third parties (payment processors, logistics carriers, app stores, event partners, analytics). Those services are governed by their own terms and privacy policies. Focus Media Communications Inc. is not responsible for third-party sites or services we do not control.

THE SERVICES AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW. Focus Media Communications Inc. DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT BE WAIVED UNDER APPLICABLE CONSUMER LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Focus Media Communications Inc. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THAT ORDER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED.

You agree to indemnify and hold harmless Focus Media Communications Inc. and its personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Services, or your violation of these Terms or applicable law.

We may update the Services and these Terms from time to time. The "Last updated" date will change when we do. Continued use after changes become effective constitutes acceptance of the updated Terms, except where mandatory law requires a different process for material changes.

These Terms are governed by the laws applicable to Focus Media Communications Inc., without regard to conflict-of-law rules, except that consumers may retain mandatory protections of their country of residence. Courts with competent jurisdiction over Focus Media Communications Inc. will hear disputes, subject to any non-waivable consumer venue rights.
